Opportunity stay
(§ 104c Residence Act)

The new opportunity stay has been in effect since December 31, 2022!

Foreigners who have been resident in the Federal territory for more than five years with a residence permit, a residence permit or a residence permit as of October 31, 2022 (reference date) are to be granted a residence permit for 18 months . The beneficiaries have 18 months, they then have the opportunity to ensure that they meet the requirements of the current § 25a and § 25b Residence Act (predominant security of livelihood, knowledge of German and proof of identity). The opportunity stay is only granted once. Spouses, life partners and underage children also benefit from the opportunity stay. Well-integrated young people and adolescents can receive a residence permit after just three years of residence and up to the age of 27 .

The opportunity stay is only granted upon application. The prerequisite is that the beneficiary is a holder of a temporary suspension of deportation .

There are some exclusions.

More than 136,000 people are likely to be affected.

What happens next?

After receiving the residence permit, the residency requirement no longer applies !

Family reunification is NOT possible.

As the holder of a residence permit according to Section 104c of the Residence Act, you are entitled to participate in an integration course .
